Getting Out The Vote Efforts

Dozens of vehicles rolled through Racine on Oct. 24, honking their horns and cheering, encouraging people in the city to “vote” as part of a series of “Pack the Polls” car parades held across Wisconsin that day. Among the drivers was Jean Brosseau, showing off her “VOTE” mask. High turnout in more urban areas, like Milwaukee and Milwaukee, has been credited with helping propel Joe Biden to the presidency.

In some states, Crispino said, prisons have explicit rules banning the receipt of blank tax forms, so her volunteers filled out relevant fields yet sometimes they still received rejection notices.

A Texas prison official did not respond to a request for comment. In Pennsylvania a prisons spokesperson could not confirm that the paperwork was being rejected by mail, but said that incarcerated people didnt need to be sent the forms because the agency has made them available after the recent court decision.

In Michigan, Department of Corrections spokesman Chris Gautz said the agency reversed course in recent days and began allowing the forms through mail, in addition to sending the information and forms to prisoners through the JPay correctional email system.

To receive the payments, incarcerated people must file a tax return by Nov. 4, even if they earned no income in 2019. Or they can register online by Nov. 21, the deadline the IRS has set for anyone who is not typically required to file tax returns.

Sample, the newsletter author, said Bureau of Prisons officials still have not fully explained why they blocked his newsletter. He hopes to rebuild his subscriber list, a process that may take years. In the meantime, he bemoaned that thousands of people in prison have lost their access to legal information.

The agency is always trying to do what they can to keep people in the dark, he said.

Prison Inmates Cant Claim Social Security Or Unemployment Benefits

According to the Social Security Administration, Social Security Disability Insurance and Supplemental Security Income payments generally arent payable for the months that youre incarcerated for committing a crime.

If you receive Social Security at the time of your conviction, your benefits will be suspended if youre in jail or prison for more than 30 continuous days. You can get your benefits reinstated starting with the month following the month of your release. However, if you are incarcerated for longer than 12 months, your eligibility for SSI benefits will be terminated and you will have to file a new application after your release.

The Social Security office cant start your benefits until your release. They must have your official release documents from the jail or prison where you were confined.

I should note that even though inmates cant receive monthly Social Security benefits while incarcerated, benefits to spouses or children will continue as long as they remain eligible.

An individual released from incarceration may be eligible for Social Security retirement, survivors, or disability benefits if they have worked or paid into Social Security enough years. They could also be eligible for Supplemental Security Income benefits if they are 65 or older, are blind, or have a disability and have little or no income and resources.

How Is It Possible That The Irs Website Would Give Advice Thats Not Consistent With The Law

Verify: Can inmates claim their own stimulus checks?

There is a well-defined process for the IRS to issue rules and regulations that supplement tax laws passed by Congress. The purported ban on stimulus payments to incarcerated people was not a result of this rulemaking process. Instead, it appears that IRS made up this rule out of whole cloth and announced it by posting it on a webpage.

Its impossible to say why the IRS took this unusual approach, but heres one theory: someone in the Treasury Department may have decided that giving money to incarcerated people is bad policy. Of course, the IRS is severely under-resourced, as a result of decades of attacks by grandstanding members of Congress, so the agency doesnt have the time or staff to go after individual incarcerated people to claw back stimulus payments. And the IRS would likely lose in court if such an action were challenged in litigation. But, by placing an FAQ on the agencys website saying that incarcerated people cannot receive the payments, some prison systems will probably do the IRSs dirty work by using the FAQ as a justification to intercept payments or bring disciplinary action against people who take the steps to claim the money to which they are legally entitled. In fact, weve heard that at least one state prison system is already doing this.

Judges Wage In On Stimulus Rights For Incarcerated Citizens

Then in late September, Forbes reported that US District Court Judge Phyllis Hamilton issued an order which included a requirement to the IRS and Treasury Department to stop withholding stimulus checks to prisoners and inmates solely on thebasis of their incarceration status.

There is nothing in the CARES Act that gives the IRS authority to decide that incarcerated people are ineligible to receive stimulus checks, said Senator Sherrod Brown , talking to Forbes Inmates who are disproportionately people of colour and from low income communities already suffer from a lack of resources and heightened exposure to Covid-19 due to the failed response to the virus by the prison system. Incarcerated people and their families need more help during this pandemic, not more undue punishment, the Senator said.

Its estimated that the judges orders could bring relief to over 80,000 incarcerated individuals who collectively should receive upwards of $100 million in stimulus checks. The population eligible for payment may be even higher as the lawsuit alleged that over 1.4 million individuals have been affected by the IRS denial of payment to prisoners and inmates.

How To Calculate The Recovery Rebate Credit For Your Inmate

Calculating the recovery rebate credit is the same as the calculation of stimulus checks. It starts with a base amount, and for most people that is $1,800. That number comes from combining the two checks $1,200 plus $600.

If the inmate is the head of a household, pays child support, or is married filing jointly basically, if the inmate is not single with no dependents then these numbers will change. Please refer to the IRS website for more information in this situation, or try out this MSN article that will go into more detail about inmates with spouses and dependents.

After adding up the base amount, then its time to determine if the recovery rebate credit is reduced because of income. Obviously, an inmate who was incarcerated throughout 2020 is not going to have any income. This means that the credit will not be reduced.

You will report the $1,800 rebate amount on Line 30 of your inmates 2020 federal income tax return. Because this is a refundable credit, they will get this amount since they have no other taxes to pay.

Remember, your inmate will be getting a paper check unless they have a bank account and you have that info for direct deposit. Do not have the check sent to the inmate at the prison because most facilities do not accept direct payments to inmates.

Instead, you will have to deposit the check into the inmates account through whatever method the facility uses. Most prisons use JPay for inmate accounts.

Alabama inmates eligible for stimulus checks

A spokesperson for the Bureau of Prisons refused to confirm or deny that any inmates at federal facilities have received stimulus payment debit cards from the IRS.

Yaman Salahi, a partner at the San Francisco-based law firm Lieff Cabraser Heimann & Bernstein, said his office gets hundreds of calls and emails every week from incarcerated people around the country and their families who are trying to secure federal stimulus payments.

After the CARES Act was passed in March 2020, the IRS determined incarcerated people were not eligible for stimulus payments.

Salahi’s firm filed a class action lawsuit that successfully challenged the IRS’s policy, and the government eventually dropped an appeal to the lawsuit in December. But Salahi said it is still very difficult for incarcerated people to receive payments.

“Incarcerated people are amongst the least-able to jump over all the hurdles and overcome all the barriers that have been placed in the way of trying to get these payments,” he said. “They are required to somehow obtain tax forms, which are usually not available in prisons, figure out how to fill them out without the assistance of professionals, mail them in, and then receive the payment.”

Salahi said getting the payments into inmate bank accounts has been a significant challenge.

On October 14, a district court for the Northern District of California granted summary judgment in Scholl v Mncuhin, a case that challenged the IRSs policy of excluding inmates from receiving $1,200 stimulus checks. The court also made permanent the preliminary injunction it had issued earlier this month, which means that the IRS and Treasury Department cannot withhold stimulus checks solely based on an individuals incarceration status. The government could still appeal the courts ruling again , but the permanent injunction should be cause for celebration for the over two million incarcerated individuals in the U.S. who may now be eligible for an economic impact payment.
